It has been raining continuously in Lagos and all parts of the country. It is mid-October and the the rain is not showing signs of abating soon. Is this an effect of climate change? That is a subject matter of discourse for another day. There is a saying that all lands are presumed dry until it rains. How then do one know a real dry land even in this season. Here are some tips for you:
One, consider the soil texture. It is admitted that when it pours heavily, the ground will surely be wet, and one may as well find pool of water in low level parts of the soil. This is especially so if the land is undeveloped with no extensive drainage facilities. But, can you see the grain of sands? Is the soil marshy, submerged in discoloured streams with undergrowth weeds and croacking of toads? If the former is the case, and the land is smooth, grainy and clear, it is dry.
Two, check the surrounding terrain. Is the land unaccessible? Is the area critically waterlogged? These are redflags you should not ignore.

Certificate of Occupancy (C of O): Pros and Cons.
Few weeks ago, like a seer, I wrote extensively on good reasons to invest in properties at Ibadan. Do you remember? At the end, I suggested you invest in Christal Villa, Kentop, Ebelu GRA then going for N800,000 per plot. It's my pleasure to inform you that it is now priced at N3 million per plot. That's about 400 percent appreciation. The deciding factor for this drastic change of price is that it now has a C of O.
Certificate of Occupancy (C of O) is evidence that the Governor of a State has granted a statutory right of occupancy as contained in Section 5 of the Land Use Act on a specific area of land. It vests on any holder, the right over that land for a definite term, usually a period of 99 years.
From experience, it is common to hear people insist on lands with C of O for obvious reasons. It guarantees the client of no mishap in future as well as demonstrates that the land is suitable and ready for occupation. That's about the benefits of a C of O. It is submitted here that experienced real estate investors do not subscribe to land with C of O for sound reasons.
First, they are usually highly priced. For instance, an investor who bought into Christal Villa will make massive returns in a split second when the C of O gets issued. Being long in the game, investors know that since they do not intend to occupy the land immediately, it is not prudent to go for land with C of O, business-wise. Besides, whereas C of O is for a definite term (99 years), other land titles are held in perpetuity for as long as such land right exist.
Is C of O really necessary? Absolutely, should you want a ready-to-build land! Do you intend to invest? Optimize profits! Opt for lesser land titles and play the waiting game.

The dualization (six lanes) of the Lekki Epe Expressway has begun, and the Lagos state Government is doing all possible to see that construction of the road is met before the year ends. Vehicular movement in that axis has risen up to 60% since March this year and Commuters are quite relieved of the fear of congestion on the axis since the commencement of the dualization.
“It is now clear that we have to dualise the Lekki-Eleko Road beyond the Zone in order to withstand the influx of vehicle that will be making use of the road to access the Zone. With this, we will be able to sustain the investments in the area.”
Ambode expressed optimism that with the Lekki Deep Sea Port, Dangote Refinery and Lekki Airport coming on board, the Lagos East axis would witness massive economic turnaround within the next two years.
Besides, Ambode also commended residents for the peaceful atmosphere witnessed in the Zone in the last one year, which, according to him, was crucial to the development recorded in recent time.
He said about 800 hectares of land would be handed over to the Zone within the next six months for further development.
“The overall interest is for the residents of Lagos because aside that we will grow the GDP of the state, this place will help to reduce unemployment and capacity for the future,” he said.

*THINGS TO CONSIDER BEFORE MAKING LAND PURCHASE:-*
Certain considerations must weigh on one's mind before making any land purchase. These should inform one's decisions and guide the choices to make:
1. *LOCATION:*
It is a common saying that for one to reap great returns on land investment: location is everything!
The value placed on any land, more often than not, is always depended on the location. This also largely determines the prices of land. A land proximate to massive projects, developments and business concerns is bound to appreciate faster than anyone else. You know that Ibeju Lekki is the best location to buy land in Africa today for this reason. Don't you?
2. *EXISTING RIGHTS:*
Enquires about the status of any land as regards this is germane. Such interests may vitiate the title of a new purchaser. By existing land rights we mean, mortgages, leases, charges, liens, etc.
In recent times, findings have revealed that some people's purchase claims are simply subleases. Land can be leased for as long a term as 99 years, the right of such lands reverting to the lessor or his heirs after the expiration of the term. A land under committed acquisition is a No, No! Government can decide at any time to use such lands for their specific purposes and all structures erected on them can be destroyed. Even such unlicensed "squatters" can be prosecuted.

THE LAND USE CHARGE AND ITS IMPLICATIONS FOR LAND OWNERSHIP
Recently, the Lagos State Government implemented a new Land Use Charge Law (LUCL), 2018. The LUCL repealed the Land Use Charge Law, 2001 and provided for a standardised and regulated system, much clarity in the formulae for calculating the charge as well as possibility of self-assessment.
The Law with 27 sections harmonised pre-existing land charges and attempts to increase the revenue base of the State by capturing more payers.
Opinions are widely divided as to the (un)fairness of the Law, and these have been expressed in several critical reviews.The concern here is not a reproduction of these reservations or of the provisions of the Law itself. We seek to draw inferences of the perceived implications of the Law for land ownership.
At first glance, it is the concern that the burden of payment of the charge can easily be pushed to tenants. Unlike the repealed 2001 Law, the new Law identifies 'owners or occupiers' of a lease as having the obligation of payment. It is true that the government has insisted that property owners are the one to pay, but such inelegant drafting can be exploited by unconscionable landowners. Given the housing deficits problems of Lagos State, tenants would have no choice but swallow the bitter pill. This reinforces the street slogan that: only the poor pay taxes!
Perhaps more compelling is the ripple effects of the Law on the property market. To maintain their rent profits, landowners will increase rents to meet up with the new reassessment. Although this will increase the value of properties generally, it will also invariably result in increased cost of living. In this condition, only tenants get to suffer the consequences. Isn't it time you also become a landowner?

*'3Ps' of LAND TRANSACTION*
Land, by nature, is sui generis- unlike other products, land is not an off-the-shelf commodity. One cannot walk into a 'land mart' pick what land one desires, make payment and walk away.
Due to this fact, certain cautionary measures must be taken for proper land transaction. Three of these would be given here. These are dubbed the '3Ps'.
1. *Proper Payment:*
The regime of cashless policy has whittle down the impact of this, nevertheless it is important to stress it: Never make cash payment for land! Land transaction should be routed through a financial institution for evidential purposes. When an online payment platform is utilized, successful transaction details should be printed and safely kept.
2. *Proper Parties:*
It is instructive that where a person wants to reserve the spouse's name to reflect in the land purchase agreement, such name must be written out in full.
To illustrate, the proper parties are, "Mr. Edward Owolabi and Mrs. Ronke Owolabi" and not "Mr. and Mrs. Owolabi." Using the latter is vague and can result in needless controversy in future. Simply put, where one buys land from a person who by right has no title to such property, one has only succeeded in buying nothing.
Unlike other products, proof of payment does not ipso facto amount to proof of title to land. Buying land from unscrupulous and fraudulent elements, who are unfortunately increasing in this clime and are lying in wait to pry on innocent people, will amount to buying a law suit.

LAND MATTERS 14.0
*A DEED OF GIFT*
Jude and Wole are office pals. They keep confidence of each other and have become inseparable. It was few days to Valentine. Wole was lost in thought and he didn't see Jude enter his office.
*Jude:* (slaps him playfully on his back) O'boy, why you dey look dejected? They don give you query?
